1. Acceptance of Terms
By accessing or using the MirKai website (mirkai.com) or purchasing any service from MirKai, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, please do not use our website or services. These Terms apply to all visitors, users, and clients.
MirKai reserves the right to update these Terms at any time. Continued use of the website or services after updates are posted constitutes acceptance of the revised Terms.
2. About MirKai and Our Services
MirKai is a booking systems implementation company founded by Lency Leon. We are not a marketing agency. We build, configure, and deploy automated booking and CRM systems for appointment-based service businesses using the GoHighLevel (GHL) platform and related tools.
Our services include:
- Free Booking Gap Audit: A 5-question assessment (60 seconds) that generates a personalized, non-binding report. No purchase required or implied.
- Booking Gap Audit ($49 one-time): A 45-minute strategy session with a written action plan. The $49 is credited toward setup if you move forward.
- Booking System Setup ($699 one-time): Full implementation of a custom booking automation system within 2 weeks of strategy call completion.
- Monthly Support ($299/month): Ongoing optimization, monitoring, and strategy support. Available after setup. Cancel anytime.
GoHighLevel Requirement: All paid services require a GoHighLevel (GHL) subscription (~$97–$297/month), billed directly by GoHighLevel, separate from MirKai's fee. MirKai is not affiliated with GoHighLevel and earns no commission on GHL subscriptions.
SMS Usage Policy: The $699 Booking System Setup includes up to 150 operational SMS messages per month (for lead follow-up and appointment reminders). Email automation is unlimited. If your business exceeds 150 SMS/month, additional messages will be billed at GoHighLevel's cost rate (~$0.012/SMS). You will be notified before any overage charges are applied. Most clients use 80–120 SMS/month.
3. Website Use
You agree to use the MirKai website only for lawful purposes and in a manner that does not:
- Infringe upon or violate the rights of others
- Transmit any unsolicited or unauthorized advertising or promotional material
- Attempt to gain unauthorized access to any part of the website or its systems
- Engage in any conduct that restricts or inhibits others' use of the website
- Scrape, copy, or reproduce our content without written permission
The Free Booking Gap Audit is provided as an educational tool to help service businesses identify gaps in their booking process. Results are estimates based on industry averages and your self-reported answers. They do not constitute a professional audit or guarantee of results.
4. Paid Services — Scope, Payment & Delivery
4a. Scope of Work
The specific deliverables for any paid service will be confirmed in writing via email or a signed proposal prior to payment. MirKai will build systems as described in the agreed scope. Any changes to scope after work begins may be subject to additional fees, discussed and agreed upon in writing.
4b. Payment Terms
- The $49 audit fee is due before the strategy session takes place.
- The $699 one-time setup fee is due in full before implementation begins.
- The $299/month support plan is billed monthly and may be cancelled with 30 days' written notice.
- Payments are processed via secure payment methods as presented at time of purchase.
- All prices are in US Dollars (USD) unless otherwise stated.
4c. Implementation Timeline
MirKai guarantees implementation within 2 weeks of the completion of your onboarding strategy call and receipt of all required access and information (GHL account, business details, etc.). Delays caused by client non-responsiveness or incomplete onboarding information will extend the timeline accordingly and do not constitute a breach by MirKai.
4d. Client Responsibilities
To enable MirKai to build your system, you agree to:
- Set up or provide access to your GoHighLevel account as directed
- Provide business information, branding, and content as requested
- Respond to strategy call invitations and onboarding questions in a timely manner
- Designate a primary contact for project communication
5. Refund & Cancellation Policy
5a. $49 Booking Gap Audit
The $49 audit fee is non-refundable once the strategy session has taken place. If you have not yet had your session, a full refund will be issued within 5 business days of request.
5b. $699 One-Time Setup
Due to the custom, labor-intensive nature of our work, the $699 setup fee is non-refundable once implementation has begun. If you cancel before the strategy call is completed and before any implementation work has started, a full refund will be issued within 5 business days. MirKai offers a 30-day satisfaction guarantee: if your system is live and you have not seen measurable improvement within 30 days, a full refund will be issued.
5c. $299/Month Support Plan
The monthly support plan may be cancelled at any time with 30 days' written notice. No long-term contract is required. No partial-month refunds are issued. MirKai may, at its sole discretion, offer a pro-rated refund in cases of documented service failure.
5d. Free Booking Gap Assessment
The free online assessment is provided at no charge. No refund policy applies as no payment is taken.
6. Ownership of Work Product
Upon completion of the $699 setup or upon implementation through the monthly support plan, you own your booking system and all data within it. This includes your contacts, automations, pipelines, and custom booking forms within your GoHighLevel account.
MirKai retains ownership of any proprietary methodology, templates, frameworks, and process documentation used to build your system. You may not resell, license, or replicate MirKai's implementation methods for commercial use without written permission.
All content on the MirKai website — including text, graphics, logos, and design — is the intellectual property of MirKai and protected by applicable copyright law. Unauthorized reproduction is prohibited.
7. Results Disclaimer
MirKai builds systems that are designed and proven to improve booking conversion rates, reduce no-shows, and recover lost leads. However, we cannot guarantee specific revenue results, booking increases, or conversion rates as outcomes depend on numerous factors outside our control, including but not limited to:
- Your current lead volume and marketing spend
- The quality and responsiveness of your existing customer service
- Market conditions and local competition
- Client cooperation during onboarding and ongoing use of the system
Testimonials and case studies referenced on our website reflect real results from individual clients and are not a guarantee of your results. Industry statistics cited (e.g., 391% conversion increase, 87% non-response rate) are sourced from publicly available industry research and are presented for educational context.
8. Third-Party Services
Our services rely on third-party platforms including GoHighLevel, Formspree, Zapier, and others. MirKai is not responsible for interruptions, changes in pricing, feature deprecations, or policy changes made by these third-party providers. We will work with you to adapt your system to any material changes, but cannot guarantee continuity of all third-party features.
GoHighLevel subscription fees are the client's responsibility and are charged directly by GoHighLevel, not MirKai.
9. Confidentiality
Both parties agree to keep confidential any proprietary business information shared during the engagement. MirKai will not disclose your business data, customer lists, or system details to third parties (other than as required to build your system). Clients agree not to share MirKai's proprietary templates, workflows, or implementation processes with competitors.
10. Limitation of Liability
To the maximum extent permitted by applicable law, MirKai's total liability to you for any claim arising from the use of our website or services shall not exceed the amount you paid to MirKai in the three (3) months immediately preceding the claim.
MirKai is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless MirKai, its founder, employees, and agents from any claims, losses, or damages arising from: (a) your breach of these Terms; (b) your use of third-party platforms in violation of their terms; or (c) content you provide to MirKai that infringes third-party rights.
12. Dispute Resolution
We believe most disputes can be resolved through honest conversation. If you have a concern:
- Step 1 — Direct communication: Contact us via the contact form. We commit to responding within 2 business days.
- Step 2 — Good-faith negotiation: Both parties agree to attempt resolution through good-faith discussion for at least 30 days before pursuing formal action.
- Step 3 — Binding arbitration: If unresolved, disputes shall be settled by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English.
These Terms are governed by the laws of the United States. Both parties waive the right to a jury trial and to participate in a class action lawsuit.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States applicable in the state where MirKai's principal operations are located, without regard to conflict of law provisions.
14. Entire Agreement
These Terms, together with our Privacy Policy and any written scope-of-work agreement between you and MirKai, constitute the entire agreement between you and MirKai regarding the subject matter herein and supersede all prior communications, representations, or agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
